Welcome to FreeData, a service provided by iBoard Technologies Limited ("we",
"us", "our", or "iBoard") in partnership with
iBoard Technologies Limited.
These Terms and Conditions ("Terms") govern your use of the FreeData service ("Service"). By
accessing or using the Service, you agree to be bound by these Terms. If you do not agree,
please do not use the Service.
1. Service Description
FreeData is an innovative reward-based advertising platform that allows users to earn free
mobile data by watching video advertisements. Key features of the Service include:
- Users receive mobile data bundles as rewards for watching complete video advertisements
- Data bundles are automatically credited to the user's mobile phone number upon successful
completion of viewing requirements
- The Service displays advertisements from local and international brands
- Reward amounts (e.g., 5 MB, 10 MB, 20 MB) are clearly displayed before users choose to watch
an advertisement
- The Service is currently available exclusively to Safaricom prepaid and postpaid customers
in Kenya
2. Eligibility and Registration
To use the FreeData Service, you must meet the following
requirements:
- Age Requirement: You must be at least 18 years of age. The Service is not
intended for persons under 18 years
- Valid Mobile Number: You must provide a valid Safaricom mobile phone number
registered in your name
- Network Provider: You must be an active Safaricom prepaid or postpaid
customer in Kenya
- Device Requirements: You must have a data-enabled mobile device with a
compatible web browser or the FreeData application
- Acceptance of Terms: You must read and accept these Terms and Conditions
and our Privacy Policy before using the Service
- Account Information: You are responsible for maintaining the accuracy of
your registration information
3. How the Service Works
The FreeData Service operates as follows:
- Registration: Enter your Safaricom mobile number and accept these Terms and
our Privacy Policy
- Ad Selection: Choose from available advertisements, each displaying the
data reward amount and duration
- Ad Viewing: Watch the complete advertisement without skipping or closing
before completion
- Reward Crediting: Upon successful completion, mobile data is automatically
credited to your Safaricom number within 5 minutes
- Balance Checking: Check your data balance using Safaricom's standard
methods (USSD code, MySafaricom app, etc.)
4. Data Rewards and Limitations
The following rules apply to data rewards earned through the
Service:
- Earning Requirements: You must watch the entire advertisement to completion
to receive the data reward. Closing, skipping, or interrupting an ad before completion will
result in no reward
- Daily Limits: There are daily limits on the number of advertisements you
can watch and the amount of data you can earn. These limits ensure fair access for all users
and may vary based on advertising inventory and user preferences
- Non-Transferability: Data rewards are credited directly to your registered
mobile number and cannot be transferred, shared, or gifted to other users
- No Cash Value: Data rewards cannot be exchanged, redeemed, or converted to
cash or any other form of compensation
- Expiration: Earned data bundles are subject to expiration dates determined
by Safaricom's standard data bundle policies. Validity periods will be communicated by
Safaricom when data is credited
- Network Integration: Earned data is added to your primary Safaricom data
balance and can be used for all standard data services
5. User Conduct and Prohibited Activities
Users are prohibited from engaging in the following
activities:
- Fraud and Misuse: Using the Service in any fraudulent, deceptive, or
dishonest manner
- Automation: Using bots, scripts, automated systems, or any form of
automation to interact with the Service or watch advertisements
- Multiple Accounts: Creating or operating multiple accounts to circumvent
daily limits or earn additional rewards
- Technical Manipulation: Attempting to hack, reverse engineer, or manipulate
the Service's technology or security measures
- False Information: Providing false, inaccurate, or misleading information
during registration or use of the Service
- Service Disruption: Interfering with the Service's operation or other
users' access to the Service
- Unauthorized Access: Attempting to access accounts, data, or systems that
you are not authorized to access
Violation of these prohibited activities may result in immediate suspension or termination of
your account, forfeiture of earned rewards, and potential legal action.
6. Advertising Content Standards
The FreeData Service maintains strict content standards:
- Quality Content: We partner with trusted local and international brands to
provide relevant, high-quality advertisements
- Content Restrictions: We do not serve alcohol-related or gambling-related
content as a matter of policy
- Brand Safety: All advertisements appear in a controlled, premium
environment with strict content policies
- Relevance: We strive to show advertisements relevant to your interests and
may periodically request preference information
- No Control: While we screen advertisements, we do not control third-party
content and are not responsible for the accuracy or quality of advertised products or
services
7. Service Availability and Technical Issues
- Service Availability: We strive to maintain continuous Service availability
but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to
maintenance, updates, or technical issues
- Internet Connection: Users are responsible for their own internet
connectivity. Unstable connections may interrupt advertisements and prevent reward crediting
- Technical Problems: If an advertisement freezes or experiences technical
issues, users should refresh the page or restart the application. Persistent issues should
be reported through our Contact Us feature
- System Delays: In rare cases, there may be delays of up to 5 minutes for
data rewards to be credited. Longer delays should be reported to our support team
- No Liability: We are not responsible for technical issues, interruptions,
failures, or delays that may affect your participation in the Service or the delivery of
data rewards, including issues caused by your device, network provider, or internet
connection
8. Data Protection and Privacy
Your privacy is important to us. Our data practices comply with the Data Protection Act,
2019 of Kenya:
- Information Collection: We collect only necessary information including
your mobile phone number, network provider, usage data, and technical information
- Purpose: Information is used to provide the Service, credit rewards,
prevent fraud, and improve user experience
- Advertiser Privacy: We do not share your personal information with
advertisers
- Consent: By using the Service, you consent to the collection and processing
of your data as described in our Privacy Policy
- Your Rights: You have rights under the Data Protection Act, 2019, including
access, correction, deletion, and objection to processing

9. Intellectual Property Rights
- Ownership: All content, features, functionality, trademarks, logos, and
intellectual property in the FreeData Service are owned by iBoard Technologies Limited, its
partners, or licensors
- Limited License: We grant you a limited, non-exclusive, non-transferable
license to access and use the Service for personal, non-commercial purposes only
- Restrictions: You may not copy, modify, distribute, sell, or exploit any
content or functionality of the Service without our express written permission
- Advertiser Content: Advertisements and related content are the property of
respective advertisers and are protected by applicable intellectual property laws
10. Service Modifications and Termination
- Right to Modify: We reserve the right to modify, suspend, discontinue, or
terminate the Service or any feature thereof at any time, with or without notice
- Terms Updates: We may update these Terms from time to time. Continued use
of the Service after changes constitutes acceptance of the modified Terms
- Account Termination: We reserve the right to suspend or terminate your
access to the Service at our sole discretion, with or without cause, including for violation
of these Terms
- Effect of Termination: Upon termination, your right to use the Service will
immediately cease. Any pending rewards may be forfeited if termination is due to Terms
violations
- User-Initiated Termination: You may stop using the Service at any time by
discontinuing access to the platform
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. iBoard
Technologies Limited does not warrant that:
- The Service will function uninterrupted, securely, or be available at any particular time or
location
- Any errors or defects will be corrected
- The Service is free of viruses or other harmful components
- The results of using the Service will meet your requirements or expectations
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY KENYAN LAW, iBoard Technologies Limited, its directors,
officers, employees, partners, and affiliates SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER
INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES,
RESULTING FROM:
- Your access to, use of, or inability to use the Service
- Any conduct or content of any third party on or through the Service
- Unauthorized access, use, or alteration of your data or content
- Technical failures, interruptions, or delays in data reward delivery
- Any errors, mistakes, or inaccuracies in Service content
13. Indemnification
You agree to indemnify, defend, and hold harmless iBoard Technologies Limited,
iBoard Technologies Limited,
and their respective officers, directors, employees, contractors, agents, and affiliates from
and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses
(including reasonable attorney's fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any fraudulent or illegal activity conducted through your account
14. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance
with the laws of the Republic of Kenya, without regard to its conflict of law provisions
- Jurisdiction: Any disputes arising out of or relating to these Terms or the
Service shall be subject to the exclusive jurisdiction of the courts of Kenya
- Dispute Resolution: Before initiating formal legal proceedings, parties
agree to attempt to resolve disputes amicably through good faith negotiations
- Alternative Dispute Resolution: If negotiations fail, parties may pursue
alternative dispute resolution mechanisms including mediation or arbitration under Kenyan
law
15. Severability and Waiver
- Severability: If any provision of these Terms is held to be invalid,
illegal, or unenforceable, the remaining provisions shall continue in full force and effect
- Waiver: No waiver of any term or condition shall be deemed a further or
continuing waiver of such term or any other term, and our failure to assert any right or
provision under these Terms shall not constitute a waiver of such right or provision
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and
iBoard Technologies Limited regarding the use of the FreeData Service and supersede any prior
agreements, representations, or understandings between you and us.

18. Acknowledgment
BY USING THE FREEDATA SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS,
UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT
USE THE SERVICE.
